NPL Privacy Policy

Background
National Pickleball League (NPL) is the premium pickleball organisation of Australia. The NPL brand offers Australia’s professional national league, tournaments, corporate days, school/university programs, social leagues, events & introductory Pickleball days. NPL aims to build the total number of Pickleball players in Australia via professional league pathways, marketing, content & venue investment.

NPL  is committed to providing quality products & services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information. This policy describes how NPL collects, holds and uses personal information.  By providing your personal information to NPL, you consent to it’s use, storage and disclosure in accordance with this policy.

NPL has adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information. What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual.

Examples of Personal Information we collect include

 

  1. contact information, such as your name, phone numbers, address details, email address and social media details (for example, your Facebook name, or Instagram handle):

  2. your date of birth, age, gender, pickleball rankings and results;

  3. details of pickleball programs that you have participated in and the organisations that you have participated with;

  4. details of a disability you may suffer, if you elect to provide that information to allow NPL to provide you with relevant services, information and assistance;

  5. details of your cultural background, nationality, and language(s) spoken, if you elect to provide that information to allow the NPL  to provide you with culturally sensitive information, services and assistance;

  6. copies of communications between NPL and you;

  7. information regarding any outstanding payments owed by you and NPL

  8. your payment details, if you apply for membership, purchase of goods or services from, or make other payments to, NPL or their agents, licensees or contactors;

  9. details of your academic qualifications, results, professional interests, reference checks, car registration and drivers licence details (if applicable), if you apply for employment or volunteer positions with NPL or where otherwise in connection with an investigation conducted by NPL

  10. background checks, including reference checks, police checks, working with children checks and completed member protection declarations and related documents. This personal information may be obtained and retained by NPL as necessary if:
    (i) you apply for, and/or obtain employment or a volunteer position;
    (ii) you are proposing to, or provide certain services to NPL
    (iv) you apply for and/or obtain accreditation at an NPL event
    (v) you are a pickleball player participating in one of our programs or a pickleball tournament, competition or event;
    (vi) you are involved in a matter or investigation conducted NPL
    (vii) appropriate in the circumstances to obtain background checks in relation to you before entering into contracts, arrangements or understandings with you, or entities related to you;

  11. medical information and emergency contact details. For example, this information may be held about you if you are a tennis player and/or have elected to participate in fitness or sporting activities,

  12. non-personally identifiable information, such as your IP address, browser type, web pages visited (that may, if combined with other information, be personal information); and

  13. other personal information provided voluntarily by you. For example, this could be information provided by you in response to NPL surveys or competitions.

 

This Personal Information is obtained in many ways including provided by you, if you:

  • are a pickleball player

  • attend any NPL Venue and hire a court

  • participate in any NPL Venue program

  • participate in any social or corporate event at an NPL Venue

  • participate in any coaching at an NPL Venue

  • purchase an NPL Membership

  • attend a pickleball activity or event and participate in activities during that event;

  • purchase a ticket or an NPL Pickleball event

  • purchase merchandise, or other products or services, from NPL or an authorised agent or licensee;

  • redeem a partner offer via NPL sponsors & partners

  • wish to apply for employment at, or volunteer for NPL;

  • wish to provide services to NPL

  • enter a competition or promotion being conducted by NPL

  • engage with an NPL via email, telephone, mail or social media;

  • elect to receive pickleball related newsletters or other information;

  • submit information to NPL  an application or consent form, survey, feedback form, incident report or complaint; or

  • when you enter your personal information, or consent to your personal information being entered into, one of NPL online IT systems ​when you engage with NPL  in the course of it providing and delivering Pickleball related services, operations and other activities, including automatically when you use one of NPL websites or mobile applications (for example, www.nplpickleball.com.au, book.nplpickleball.com.au, or a website or mobile application managed by NPL)

 

You can choose not to provide NPL with some or all of the personal information that it requests. However, this may affect how NPL can communicate with you and provide its products and services to you, as well as your ability to participate in the NPL’s programs and apply for employment or volunteer positions with NPL. If it is unreasonable or impracticable for NPL to deal with you where you have not provided the information or consents that it requests, it may have no realistic option but to decline to do so.

NPL  will generally collect personal information regarding a child under the age of 16 years from the parent or other ‘responsible person’ associated with that child. At times NPL may collect personal information regarding an adult from another ‘responsible person’ associated with that adult.

Why we collect Personal Information


We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information, we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information. Sensitive information will be used by us only:

  1. For the primary purpose for which it was obtained

  2. For a secondary purpose that is directly related to the primary purpose

  3. With your consent; or where required or authorised by law.

 

Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Disclosure of Personal Information

Your Personal Information may be disclosed in a number of circumstances including the following:

 

  • Third parties where you consent to the use or disclosure; and

  • Where required or authorised by law.

 

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information.  However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

Access to your Personal Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing. NPL will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.

 

Maintaining the Quality of your Personal Information

It is important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.
